By accessing or using the Mogyou application and website (the "Service"), you agree to be bound by these Terms & Conditions. If you disagree with any part of the terms, you may not access the Service. These terms apply globally to all users, regardless of location.
MOGYOU IS NOT A MEDICAL DEVICE, MEDICAL PROVIDER, OR LICENSED FITNESS PROFESSIONAL.
The Service utilizes artificial intelligence to analyze user-uploaded photos and provide automated fitness, aesthetic, and skincare suggestions. All information, routines, and analyses provided by Mogyou are strictly for educational and entertainment purposes.
Mogyou provides immediate access to digital content and AI-generated analyses. Due to the nature of digital goods, all sales and subscriptions are generally final.
For EU/UK Consumers (Right of Withdrawal): By purchasing a subscription or credits, you expressly consent to the immediate execution of the contract and acknowledge that you will lose your 14-day right of withdrawal (widerrufsrecht) once the digital content has been fully provided or the AI generation has commenced. We cannot refund credits or subscriptions for scans that have already been processed.
You must provide accurate information when creating an account. You are responsible for safeguarding the password that you use to access the Service. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through the in-app Settings via our billing provider (Stripe).
You agree not to misuse the Service or help anyone else do so. You must not:
The Service, including its original content, features, and functionality, are owned by Mogyou and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
To the maximum extent permitted by applicable law, in no event shall Mogyou, its affiliates, agents, directors, or employees, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.
Mogyou is operated from Austria. These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
Global Consumer Protection: If you are a consumer residing outside of Austria, this governing law provision does not deprive you of the mandatory consumer protections provided by the laws of your country of residence. In the event of a dispute, consumers may bring legal proceedings in the courts of Austria or in the competent court of their country of habitual residence.
We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes through the Service. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
